Filling vacancies on the Supreme Court has become an especially politicized process in the last twenty years. The heart of the controversy involves disagreement over judicial philosophy discussed in your textbook as judicial activism and judicial restraint. This assignment will give you excellent insight into what two leading proponents of the two philosophies see as the results of the Court's propensity toward the liberal version of judicial activism in the last several decades. Read these two articles (one, two) and write a two page essay describing whether you think the country is better off as a result of the pursuit of this philosophy discussed by Prof. Wolff or whether you think Judge Bork's article and his position on the role of the Court is more appealing to you. I might add that Judge Bork's confirmation hearings for appointment to the Supreme Court twenty years ago raised this debate to the white hot level where it remains.
